  • Wage and Hour Disputes

    These matters involved the classification of claims adjusters as exempt v. non-exempt employees based upon a review of the actual day-to-day job duties they performed and their roles within the organization and, more specifically, whether or not they were improperly denied overtime and other benefits because of misclassification.
  • Bad Faith

    At issue was a contractual dispute involving the dual duties of the insurer to defend v. the duty to indemnify, and whether the duty to defend was breached after a coverage denial.

    This professional liability case involved a suit brought against a broker by an insured after a loss that resulted in heavy coinsurance penalties against the insured for the undervaluation of property.
  • Workers Compensation Experience Modification and Premium Dispute

    At issue in this case was whether or not improper workers compensation claims handling procedures exaggerated the insured's loss ratio and resulted in an adverse debit experience modification rating for the insured and artificially inflated the insured's premiums.
  • Workers Compensation Medical Provider Lien Dispute

    At issue was improper handling of medical lien claims of the provider by various insurers resulting in the eventual bankruptcy of the provider due to the inability to collect on outstanding liens.
